투자이민법 개요(Overview)
Under section 203(b)(5) of the Immigration and Nationality Act (INA), 8 U.S.C. ?1153(b)(5), 10,000 immigrant visas per year are available to qualified individuals seeking permanent resident status on the basis of their engagement in a new commercial enterprise.
이민법 규정에 따라, 새로운 기업 창립으로 영주를 희망하는 사람들에게, 매년 10,000개의 이민비자가 발급된다.
Of the 10,000 investor visas (i.e., EB-5 visas) available annually, 5,000 are set aside for those who apply under a pilot program involving an CIS-designated Regional Center.

○ Demonstrate that a "qualified investment" (see below) is being made in a new commercial enterprise located within an approved Regional Center; and,
적정한 투자가 승인된 Regional Center 내의 한 지역에서 새로운 기업에 투자가 이루어지고 있음을 증명해야 한다.
○ Show, using reasonable methodologies, that 10 or more jobs are actually created either directly or indirectly by the new commercial enterprise through revenues generated from increased exports, improved regional productivity, job creation, or increased domestic capital investment resulting from the pilot program.
Pilot program에서 기인한 수출증대, 지역생산성 향상, 신규 고용창출, 지역 투자자본 증대가 세수입의 증대를 가져오고, 이러한 새로운 사업에 의해 10개 또는 그 이상의 고용 창출이 직/간접적으로 이루어 질 것임을 합리적인 방법으로 증명해야 한다.
Eligibility : 자격
Permanent resident status based on EB-5 eligibility is available to investors, either alone or coming with their spouse and unmarried children.
EB-5에 의한 영주권지위는 주신청인 혼자 또는 배우자와 미혼 자녀를 동반하는 것까지 가능하다.
Eligible aliens are those who have invested -- or are actively in the process of investing -- the required amount of capital into a new commercial enterprise that they have established.
적합한 자격을 갖춘 외국인(신청인)은 새로운 사업체 설립에 정해진 투자금을 이미 투자했거나, 또는 투자 과정에 있는 사람이다.
They must further demonstrate that this investment will benefit the United States economy and create the requisite number of full-time jobs for qualified persons within the United States.
그들은 자신들의 투자가 미국 경제에 이익을 주고 미국내에 full-time 고용인을 창출 하게 할 것임을 자세히 설명해야 한다.
In general, "eligible individuals" include those :

○ creating an original business; 새로운 사업을 만듦으로써 새 사업체를 설립하는 사람
○ purchasing an existing business and simultaneously or subsequently restructuring or reorganizing the business such that a new commercial enterprise results; or
기존의 사업체를 매입하고 동시에 새로운 사업체를 설립한 것과 동일한 결과를 가져올 수 있도록 매입한 사업체를 restructuring 함으로써 새 사업체를 설립했다고 볼 수 있는 사람
○ expanding an existing business by 140 percent of the pre-investment number of jobs or net worth, or retaining all existing jobs in a troubled business that has lost 20 percent of its net worth over the past 12 to 24 months; and
고용인 수나 사업체의 순 자산을 140% 이상 확대하거나, 과거 12~24개월동안 순 자산의 20% 이상의 손실이 나고 있던 사업체에 고용되어 있던 기존의 고용인들을 유지하도록 하여 새 사업체를 설립한 것과 동일한 효과를 만들어 냈다고 볼 수 있는 사람
2. Who have invested -- or who are actively in the process of investing -- in a new commercial enterprise:
새로운 사업체에 투자를 아래와 같이 투자를 했거나, 투자하고 있는 사람
○ at least $1,000,000, or 최소한 100만불 또는
○ at least $500,000 where the investment is being made in a "targeted employment area," which is an area that has experienced unemployment of at least 150 per cent of the national average rate or a rural area as designated by OMB; and “targeted employment area,"
최소한 50만불의 투자를 한 사람 (targeted employment area,"란 National 평균 실업률의 최소 150%이상의 실업률을 보이고 있거나 OMB에 의해 전원지역으로 정해져 있는 곳을 말한다.)
3. Whose engagement in a new commercial enterprise will benefit the United States economy and:
새로운 사업체는 미국 경제에 아래와 같은 이익을 줄 것이다
○ create full-time employment for not fewer than 10 qualified individuals; or
최소한 10명 이상의 새로운 고용 창출 또는
○ maintain the number of existing employees at no less than the pre-investment level for a period of at least two years, where the capital investment is being made in a "troubled business," which is a business that has been in existence for at least two years and that has lost 20 percent of its net worth over the past 12 to 24 months.
과거 12~24개월 동안 순 자산의 20% 이상의 손실이 나고 있던 사업체에 최소한 2년간의 선 투자를 함으로써 기존의 고용인들을 유지해야 한다.

In order to seek status as an immigrant investor, you must file CIS Form I-526, Immigrant Petition by Alien Entrepreneur. The Form I-526 must be filed with supporting documentation which clearly demonstrates that the individual investment meets all requirements, such as:
투자이민비자를 신청하고자 한다면 CIS Form I-526을 제출한다. CIS Form I-526에는 신청인이 하고자 하는 투자가 아래와 같은 모든 투자조건에 부합한다는 것을 명확히 증명할 수 있는 근거 서류들과 함께 제출되어야 한다.

◎ Applying for an immigrant visa at a U.S. Consulate abroad, if residing outside the United States.
